SERVICE AGREEMENT

Terms of Service

These terms govern the SDA Hymnal Songs website, the future installable Progressive Web App (PWA), and related supported mobile experiences. They are separate from Apple’s standard app license terms.

Service description

SDA Hymnal Songs provides digital access to an Adventist hymn library and related features that may include search, lyrics, available sheet music, audio playback, and curated worship albums. The service currently includes a public website and iOS/iPadOS app and is being prepared for a future installable web version for supported browsers and devices.

Personal-use license

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the service on supported devices for private worship, study, and other lawful personal purposes. No ownership interest in the service or its content is transferred to you.

Free and Premium access

Some features or content may be available without charge, while others may require Adventist Hymnal Premium. The current feature set, plan availability, price, currency, and billing frequency will be displayed on the Pricing page and at checkout. Features may differ by platform, version, territory, or content availability.

Payments, automatic renewal, and cancellation

Monthly and annual Premium subscriptions renew automatically at the disclosed billing interval unless canceled before the next renewal date. The applicable price, currency, frequency, and any taxes will be shown before purchase. You authorize the relevant store or payment provider to charge each renewal until cancellation.

For web subscriptions, cancel through the link in your Paddle receipt or Paddle buyer portal. For App Store subscriptions, cancel through your Apple Account subscription settings. Cancellation stops future charges and ordinarily takes effect at the end of the current paid billing period. Cancellation does not itself create a right to a refund. See the Refund Policy.

Paddle purchases and Apple purchases

Web: Paddle acts as Merchant of Record for eligible web purchases. Paddle processes the transaction and provides the receipt and buyer-management tools. Paddle’s Buyer Terms (opens in a new tab) apply to that transaction, while these Terms govern your use of the service.

Apple: Purchases made in the iOS or iPadOS app are processed by Apple and are also subject to Apple’s applicable media-services and App Store terms. Apple controls billing, cancellation, and refund decisions for those purchases. Paddle cannot manage an Apple transaction.

Acceptable use

You must not misuse the service; interfere with its security or operation; bypass access controls; use automated means to scrape or extract content; reverse engineer the service except where law expressly permits it; share, resell, or transfer Premium access; upload malicious code; infringe intellectual-property or privacy rights; or use the service for unlawful, deceptive, or abusive activity.

Intellectual property

The service software, branding, visual design, compilations, and original materials are owned by or licensed to the service operator and are protected by applicable intellectual-property laws. Hymn texts, music, recordings, artwork, and sheet music may be owned by their respective rights holders, licensed, or in the public domain. Your access does not grant permission to redistribute, publicly perform, reproduce, or commercially exploit content beyond rights provided by law or an applicable license.

Availability and service changes

We may maintain, update, add, remove, or change features and content, including because of licensing, technical, safety, or legal requirements. We do not promise uninterrupted or error-free availability, support for every device, or permanent availability of any particular hymn, recording, or feature. We will provide notice of material subscription changes where required by law.

Disclaimers and limitation of liability

To the maximum extent permitted by law, the service is provided “as is” and “as available.” We disclaim implied warranties that may lawfully be disclaimed. We are not liable for indirect, incidental, special, consequential, or punitive damages, loss of data, or loss arising from unavailable content or third-party services. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, or your mandatory consumer rights.

Termination

You may stop using the service at any time. We may suspend or terminate access if you materially breach these Terms, misuse the service, create legal or security risk, or fail to pay applicable charges. Where appropriate and legally required, we will give notice and a reasonable opportunity to resolve the issue. Provisions that by their nature should survive termination—including ownership, disclaimers, and accrued payment obligations—will survive.

Consumer rights and governing terms

Mandatory consumer protections in your country or region continue to apply. These Terms do not designate an exclusive jurisdiction or restrict any non-waivable right or remedy available to you under applicable law. Web transactions processed by Paddle are additionally subject to Paddle’s Buyer Terms, including their provisions concerning governing law and dispute resolution.
